Terms and conditions

  1. The contract is for a short-term holiday rental of Villa Nyma, Mrgani 35, 52352 Kanfanar, Croatia
    and/or Villa Sona, Mrgani 35a, 52352 Kanfanar, Croatia made between the client and the owners of the
    Villa („the owners“), binding from the time that booking is made and inclusive of all the following
    conditions.
  2. By confirming a booking, the client enters into a contract on behalf of themselves and all members
    of their party, representing that they have the authority to accept these terms on behalf of and bind all
    guests in their group
  3. Bookings are accepted with the understanding that the property is used solely for holiday purposes,
    and the number of occupants is restricted to the amount specified on the booking form.
  4. The client and any friends or family of the client visiting the property while the client is staying there
    must adhere to the conditions of the contract, including the rules and procedures contained in the
    information folder provided in the property.
    Payment
  5. A deposit of 30% of the total rental amount is required at the time of booking if made more than six
    weeks before the rental period begins. Bookings remain provisional until the deposit is received, which
    is held for three days. The rental agreement is considered finalized once the owners receive the deposit.
    After completing the reservation and payment, the owners will send a written confirmation via email.
    If payment is not made within three days of booking, the rental agreement is considered canceled.
    The remaining balance is due 60 days before the rental period starts. Failure to pay the balance by the
    due date may be treated as a cancellation by the client.
    For bookings made less than six weeks before the rental period begins, the total rental amount is due
    immediately.

Security Deposit

  1. A security deposit of €500 is payable latest one week before arrival to:

  2. In case that the cost of the caused damage is higher than the deposited sum, the client is obligated
    to pay the total damage amount to the owner. If no damage is caused to the villa, the owner is obligated
    to refund the deposited sum to the client.
    Costs
  3. The costs of water, gas, electric power, and internet, as well as bedlinen, towels, maintenance of
    the swimming pool and exterior, registration of stay, residential tax and the value added tax are
    included in the accommodation price.
    Passport Details
  4. The client is obligated by Croatian law to provide the villa owner/villa host with official identification
    documents containing personal details for tourist registration purposes with the national tourist board
    (HTZ). This information will not be used for any other purposes. A client that will not provide any form
    of personal identification for tourist registration as required by law, may be denied access to the
    property with no possibility of refund of the paid rent.
    Cancellation
  5. Any cancellation by the client, for any reason, must be made in writing via email to
    info.istriatime@gmail.com.
  6. In the event of a cancellation the following refund conditions will be applied.
  • 100% refund for cancellations more than 60 days before check-in date.
  • 50% refund for cancellations more than 30 days and less than 60 days before check-in date.
  • 0% refund for cancellations less than 30 days before check-in date.
  1. If the cancellation terms and conditions are not considered acceptable the client is strongly advised
    to take out holiday cancellation insurance.
    Period of Hire
  2. Rentals for Villa Nyma and/or Villa Sona commence at 16:00 on the day of arrival and terminate at
    09:00 on the day of departure. Deviations from these times can be requested by email prior to the
    clients hire period. The Owners will confirm if the modified times are achievable.
  3. The arrival time should be arranged in advance. Typically, a member of the Villa Nyma and/or Villa
    Sona team will greet the guests, hand over the keys, and provide a guided tour of the property. If a
    personal welcome is not possible (e.g., due to late hours or staff unavailability), the client will retrieve
    the keys as outlined in the pre-arrival instructions.
  4. Upon departure, the client will be required to follow the pre-arrival instructions.
    Garden & Swimming Pool
  5. Children must always be supervised by adults in the swimming pool area. Guests use the swimming
    pool at their own risk. Please be aware that the pool may not be available for use outside of the summer
    season.
  6. Our Garden and Pool Maintenance Team visits the property regularly once a week in the morning
    for approximately 30 minutes per visit. They have keys and access to the exterior of the House. The
    latest predicted work schedule will be included in the Welcome Pack in the house.
  7. Between maintenance visits, guests are welcome to skim the surface of the pool (e.g., removing
    insects and leaves) using the provided pool net.
  8. All other aspects of pool management (including water circulation, chemical dosing & monitoring)
    are managed by a combination of automatic processes and manual intervention (by the Garden and
    Pool Maintenance Team). It is strictly forbidden for guests to chemical dose or change settings in the
    Swimming Pool Pump House. Guests are asked to report observed malfunctions or problems directly to
    the Owners.
    Right of Entry
  9. Whilst respecting the reasonable privacy of the client, the owners of Villa Nyma and/or Villa Sona
    reserve the right to always access all the property, if necessary, for repairs and emergencies.
    Care of the Property
  10. The client shall take all reasonable and proper care of the property and its furniture, pictures,
    fittings and effects in or on the property and leave them in the same state of repair, condition,
    cleanliness and tidiness as at the commencement of the rental period.
    The client is required to promptly report any damage to the villa or its surrounding property to the
    owner or villa host during the rental period. Upon departure, and prior to returning the keys, the client
    must inspect the villa and its surroundings with the owner or villa host. If the client departs the property
    before the inspection, the owner or villa host will assess any potential damages independently and
    deduct the cost from the Security Deposit (refer to Clause 6).
    Breakages or Damage
  11. The client is required to inform the owner of any damage or breakage in or around the property
    promptly so that it can be repaired and replaced for the next client.
  12. The client is responsible for reimbursing the owners for any replacement, repair, or additional
    cleaning costs reasonably requested due to damages caused by the client. These costs will be deducted
    from the Security Deposit (refer to Clause 6), with the remaining balance returned to the client.
    Rules and Procedures
  13. Clients are required to observe the rules and familiarise themselves with the procedures contained
    in the information folder provided in the property. If the client does not follow the house rules, that can
    be considered a severe breach of the rental contract provisions, and in this case the owner is entitled
    to terminate the rental contract immediately, without a notice period, and the client is obligated to

leave the villa permanently with all the persons staying there within 2 (two) hours, and he/ she is not
entitled to demand the return of the paid accommodation price from the owner.

Smoking

  1. Smoking is not permitted anywhere inside the holiday property. It is permitted to smoke in all
    outside areas. Each evidence of the smoking inside of the holiday property will result in additional
    cleaning charge and removing of the odor in the minimum amount of EUR 200.
    Pets
  2. Pets are allowed upon request, with an additional charge of EUR 100 for final cleaning. Pet owners
    are responsible for cleaning up after their pets, and pets are not permitted on the furniture at any time.
    Any evidence of pets on the furniture may result in additional cleaning fees. All pets must be up to date
    on vaccinations, including rabies, and comply with current regulations. Guests are advised to familiarize
    themselves with common pet illnesses in the area and take preventive measures. The care and
    supervision of pets in the villa are the sole responsibility of the guest, and the owners are not liable for
    any illness or injury the pets may incur during their stay.
    Liability
  3. The owners are not liable for any loss or damage to any client’s property or any property belonging
    to a member of the client’s party howsoever caused.
  4. The client or any members of their party cannot hold the owners liable for any personal injury or
    death, provided that the owners and/or their employees have exercised reasonable skill and care. This
    also applies where the injury or death is due to the fault of the affected person(s) or their party
    members (including insufficient supervision of children), the fault of a third party, or an unforeseeable
    or unavoidable event.
  5. Guests should take out adequate travel insurance to cover them in the event of such circumstances.
    Acts of God
  6. The owners are not liable for ‚acts of God‘ (e.g., natural disasters or other events beyond our
    control). Clients are advised to obtain sufficient travel insurance to cover such situations.
    Final provisions and jurisdiction
  7. The contracting parties will make every effort to resolve any disputes amicably. In the event of a
    dispute, the parties agree to the jurisdiction of the competent court in Zagreb and the application of
    Croatian law.
